Article 2 The term "construction, design, construction, supervision and energy-saving operation management of civil buildings refers to the implementation of energy-saving standards for civil buildings and the reduction of building use during the planning, design, construction, supervision and energy-saving operation management of civil buildings. Article 3 All provisions for the construction, reconstruction and expansion of residential buildings, public buildings and energy-saving supervision and management of civil buildings within the administrative area of ​​this Municipality shall comply with these Provisions.
Article 4 The municipal, county (city) and Shangjie District People's Governments shall incorporate the energy conservation work of civil buildings into the medium- and long-term plans and annual plans for national economic and social development.
The competent departments of construction of cities, counties (cities) and Shangjie District shall organize the preparation of energy-saving plans for civil buildings in their respective administrative areas, and report them to the people's government at the same level for approval.
Article 5 The competent departments of construction of cities, counties (cities) and Shangjie District shall be responsible for the supervision and administration of energy conservation of civil buildings in their respective administrative areas.
The municipal building energy conservation management organization affiliated to the municipal, county (city), and Shangjie District construction department is responsible for the daily management of civil building energy conservation.
Relevant departments such as development and reform, urban and rural planning, municipal administration, environmental protection, quality and technical supervision, etc. shall, within the scope of their respective duties, work together to supervise and manage the energy conservation of civil buildings.
Article 6 This Municipality encourages and supports the scientific research and technology development of civil building energy conservation, promotes the use of new energy-saving technologies, new processes, new equipment and new products for civil buildings; limits or prohibits the use of high-energy processes, equipment and products.
Article 7 The people's governments of cities, counties (cities) and Shangjie District shall take measures to encourage and support the research, development, promotion and application of the following civil building energy-saving technologies and products:
(1) Insulation and insulation technology and materials for new energy-saving walls and roofs;
(2) installing solar energy utilization systems such as solar water heating systems, lighting systems, heating systems, and heating systems;
(3) Thermal insulation and sealing technology for energy-saving doors and windows;
(4) Energy-saving air-conditioning technologies and products;
(5) Building lighting energy-saving technologies and products;
(6) Renewable energy application technologies and equipment such as wind energy and geothermal energy;
(7) Applied technologies and equipment such as clean energy and clean coal products such as natural gas;
(8) Centralized supply of cooling, heating and cogeneration of heat and power;
(9) Heating and air conditioning system temperature control and household heat metering technology and equipment;
(10) Energy-saving energy consumption testing and evaluation technology for civil buildings.
Article 8 The municipal, county (city, district) people's government shall arrange special funds for civil building energy conservation, to support scientific and technological research and standard formulation for energy conservation of civil buildings, energy conservation renovation of existing building envelopes and heating systems, The application of renewable energy, the promotion of building energy conservation, and the demonstration of building energy conservation projects, energy conservation projects, and the promotion of green buildings.
The city encourages diversified and multi-channel investment for energy-saving renovation of civil buildings, and investors can share the benefits of energy-saving renovations according to the agreement.
Article 9 Units and individuals that have made outstanding achievements in the energy conservation work of civil buildings shall be commended and rewarded in accordance with relevant state regulations.
Chapter II New Building Energy Efficiency
Article 10 The design, construction and acceptance of civil buildings shall strictly comply with the energy conservation requirements of residential buildings not less than 65% and public buildings not less than 50%, and strictly implement the national, industrial and local standards for energy conservation of civil buildings.
Article 11 When approving the general plan design and constructive detailed planning of civil construction projects, the competent department of urban and rural planning shall comprehensively consider the requirements for energy utilization and building energy conservation in terms of layout, orientation, heating and ventilation of the building, and Whether the design plan meets the mandatory standards for civil building energy conservation and seeks the opinions of the competent construction department at the same level; the competent construction department shall submit an opinion within 10 days from the date of receiving the request for comments. The time for soliciting comments is not counted within the time limit for planning permission.
Construction engineering planning licenses may not be issued for those that do not meet the mandatory standards for civil building energy conservation.
Article 12 The relevant units shall do a good job in energy conservation of civil buildings in accordance with the following provisions:
(1) The construction unit shall implement the energy conservation standards for civil buildings, specify the technical requirements for energy conservation of civil buildings and product technical indicators in the design and construction bidding documents and related contracts, and provide the construction and supervision units with the construction drawing design documents qualified for energy conservation and follow Organized inspection and acceptance of quality inspection standards for civil building energy conservation projects;
(2) The design unit shall design according to the civil building energy-saving design standards and relevant mandatory standards, specify the energy-saving content of civil buildings in the design plan and construction drawing design documents, and provide the construction unit with the construction drawing design qualified by the energy-saving review. file;
(3) The construction drawing design document reviewing agency shall review the contents of energy conservation of civil buildings when conducting the review of the construction drawing design documents, and the review opinions issued shall contain energy conservation review opinions;
(4) The construction unit shall be constructed in accordance with the construction drawing design documents and the energy-saving standards for civil buildings, and shall be responsible for the inspection of the building energy-saving products used in the construction projects, and shall be used only after passing the inspection;
(5) The supervision unit shall, in accordance with the construction drawing design documents and the energy-saving standards for civil buildings, adopt supervision in the form of side stations, inspections, and parallel inspections. Documents that agree to use shall not be signed for building energy-saving materials, components and equipment that have not been tested or failed.
Article 13 When applying for a construction permit or a construction report, the construction unit shall provide a review opinion on the construction drawing design document of the project. If it is not provided, the construction department or relevant department may not go through the construction permit formalities.
Article 14 Before the insulation project of the wall or roof of a civil building is concealed, the construction unit shall organize the acceptance of the energy-saving sub-project in accordance with the construction quality acceptance specification for civil building energy-saving projects, and shall be carried out under the supervision of the competent construction department.
The completion acceptance of civil construction projects shall be carried out after the acceptance of the energy conservation division project. When the construction unit goes through the formalities for completion and acceptance of registration, it shall submit a project acceptance report for the energy conservation division.
The competent construction department or relevant departments shall not go through the formalities for completion and acceptance of the civil construction that has not been accepted by the energy-saving branch project.
Article 15 After the completion of the civil construction listed in the government investment approval and approved investment project catalogue, the construction unit shall entrust an energy-saving inspection and testing unit with legal qualifications to test the energy use status of the project, failing to meet the reasonable energy use standards and energy conservation. If required by the design specification, the investment authority shall not accept the inspection.
Article 16 Civil construction projects shall give priority to the selection of building energy-saving materials and products.
Article 17 A real estate development enterprise that sells commercial housing shall include the basic information of building energy conservation such as energy consumption indicators, energy conservation measures and protection requirements, and insulation engineering warranty period of the commercial houses sold in the “Household Use Instructionsâ€, and the sale of public buildings shall provide construction. Energy-saving instructions, indicating the energy-saving measures and corresponding protection requirements that the building has taken.
Article 18 For buildings with renewable energy utilization conditions, the construction unit shall select suitable renewable energy sources for heating, refrigeration, lighting and hot water supply; the design unit shall design according to the standards for renewable energy utilization. .
The construction of renewable energy utilization facilities shall be synchronized with the construction of the main building project, synchronous construction, and simultaneous acceptance.
Chapter III Energy Saving in Buildings
Article 19 This Municipality gradually implements energy-saving renovation of existing high-energy-consumption buildings.
The competent departments of construction of cities, counties (cities) and Shangjie District shall, in conjunction with relevant departments, formulate plans for the renovation of existing high-energy-consumption buildings and report them to the people's government at the same level for approval.
Energy-saving renovation of high-energy-consumption buildings should focus on the transformation of public buildings, fully consider the remaining service life of the buildings, scientifically demonstrate the necessity and feasibility of the transformation, and make full use of renewable energy.
Article 20 The cost of energy-saving renovation of office buildings of state organs of cities and counties (cities, districts) shall be included in the budget by the people's government at the same level.
The cost of energy-saving renovation of public buildings used in residential buildings and public welfare undertakings such as education, science, culture, health, sports, etc. shall be shared by the government and construction owners.
Chapter IV Energy Consumption of Building Energy System
Article 21 The owner or user of the civil construction shall ensure the normal operation of the building energy system, and shall not artificially damage the building envelope structure and energy use system.
The owner or user of the public building of the office building and the single building area of ​​more than 20,000 square meters shall establish and improve the energy management system and operating procedures for civil buildings, monitor and maintain the building energy system, and regularly divide the points. The electricity consumption of the project is reported to the municipal, county (city) and Shangjie District construction authorities.
Article 22 The administrative unit of a public building shall establish and improve the building energy-saving management system and operating procedures, and monitor and maintain the building heating system, heating and cooling system, hot water supply and other facilities and equipment to ensure normal operation.
Article 23: Implement an indoor temperature control system for public buildings that use air-conditioning for heating and cooling. Except for special purposes, the indoor air conditioning temperature setting in summer shall not be lower than 26 degrees Celsius, and the indoor indoor air conditioning temperature setting shall not be higher than 20 degrees Celsius.
Article 24 Heating units shall improve technical equipment, implement metering management, monitor and maintain the heating system, improve the efficiency of the heating system, and ensure that the operation of the heating system complies with the mandatory standards for civil building energy conservation.
Article 25 Civil building lighting projects shall reasonably select lighting standards, lighting methods, and control methods, and make full use of natural light, select energy-saving products, reduce lighting power consumption, and improve lighting quality.
Article 26 The competent departments of construction of cities, counties (cities) and Shangjie District shall investigate, count and analyze the energy use of public buildings within their respective administrative areas in accordance with relevant regulations, and may publicize the energy consumption of public buildings to the public. .
Article 27 This Municipality implements the energy-saving performance testing system for civil construction projects.
The construction unit may entrust the civil building energy-saving testing agency to test the energy-saving effect of the building.
The institutions engaged in energy-saving testing of civil buildings shall obtain corresponding qualifications in accordance with relevant state regulations.
Chapter 5 Penalties
Article 28 Anyone who violates these Provisions shall be punished in accordance with the provisions of the State Council's Regulations on Energy Efficiency in Civil Buildings.
Article 29 If the competent construction department and other relevant departments have one of the following acts, the directly responsible person in charge and other directly responsible personnel shall be given administrative sanctions according to law; if a crime is constituted, criminal responsibility shall be investigated according to law:
(1) Issue a construction project planning permit for a construction project whose design plan does not meet the mandatory standards for civil building energy conservation;
(2) issuing qualified opinions on design plans that do not meet the mandatory standards for energy conservation of civil buildings;
(3) issuing a construction permit to a construction project whose construction drawing design documents do not meet the mandatory standards for civil building energy conservation;
(4) Handling the completion and registration formalities for construction projects that do not meet the mandatory standards for energy conservation of civil buildings;
(5) There are other abuses of power, negligence, malpractice, corruption and bribery.
Chapter VI Supplementary Provisions
Article 30 These Provisions shall come into force on February 1, 2009.
